Terms of Service

These Terms of Service (“Terms”) govern your access to and use of esignink.com and its electronic signature, remote online notarization, and related services (the “Services”). By creating an account or using the Services, you agree to these Terms.

1. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for your account credentials and all activity under your account.

2. Electronic signatures

The Services facilitate electronic signatures under the U.S. ESIGN Act and UETA. You are responsible for ensuring that electronic signing is appropriate and legally valid for your particular documents and jurisdiction. esignink provides the signing platform and audit trail but does not provide legal advice.

3. Notary services

Remote online notarization (RON) and in-person wet-signature services may be provided through third-party commissioned notaries and providers. Availability depends on applicable state laws. Notarization is performed by the notary, not by esignink, and is subject to the provider’s terms.

4. Acceptable use

• Do not use the Services for unlawful, fraudulent, or infringing purposes.
• Do not upload content you lack the right to use, or that contains malware.
• Do not impersonate others or forge signatures.
• Do not attempt to disrupt, reverse engineer, or gain unauthorized access to the Services.

5. Plans, billing & AI features

Paid plans are billed in advance on a recurring basis via our payment processor. Certain AI-powered features are offered on Ultra and Enterprise plans and may be released progressively; availability of specific AI features is not guaranteed and may change. AI outputs are informational only and not a substitute for professional advice. Fees are non-refundable except as required by law. You may cancel at any time; access continues through the end of the current billing period.

6. Your content

You retain ownership of documents and content you upload. You grant esignink a limited license to process and store that content solely to provide the Services. You are responsible for the accuracy and legality of your content.

7. Disclaimers

The Services are provided “as is” without warranties of any kind, express or implied. esignink does not warrant that the Services will be uninterrupted, error-free, or that any document will be legally enforceable in a given context.

8. Limitation of liability

To the maximum extent permitted by law, esignink will not be liable for any indirect, incidental, or consequential damages, or for amounts exceeding the fees you paid in the 12 months preceding the claim.

9. Termination

We may suspend or terminate access for violations of these Terms. You may stop using the Services at any time. Certain provisions survive termination, including ownership, disclaimers, and limitation of liability.

10. Changes

We may modify these Terms; material changes will be posted here with an updated date. Continued use after changes constitutes acceptance.
